Language Clause: This document is a courtesy translation of the original Polish Terms and Conditions. In the event of any discrepancy or ambiguity between the Polish and English versions, the Polish version shall prevail and shall be binding upon the parties.
These Terms and Conditions govern the rules for using the property listing platform Spotnest.com. The service is owned and operated by Piotr Rogalski, conducting an unregistered business activity (działalność nierejestrowana), with correspondence address at ul. Domaniewska 37 lok. 2.43, 02-672 Warszawa (hereinafter: the “Service Provider”).
By accessing or using Spotnest.com, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. If you do not agree, you must immediately cease using the Platform.

By creating an account, you expressly confirm that you meet the age requirement set out above. The Service Provider reserves the right to verify age declarations and to immediately suspend or terminate accounts where this requirement is not met.
Listings must accurately describe the offered property. The Service Provider reserves the right to moderate content automatically (including via AI-assisted tools) and manually, prior to or after publication.
In order to maintain the highest quality and safety standards, the Service Provider strictly prohibits the publication of any unlawful content. By submitting a listing or communicating with other users, you agree that your content will not:

The Service Provider reserves the right to review listings for compliance with these Terms and Conditions. In the event of a breach of Sections 4 or 5, the Service Provider may:
Paid services on Spotnest.com are processed exclusively through Stripe, a payment services provider operated by Stripe, Inc. (USA) / Stripe Payments Europe, Ltd. (Ireland), subject to Stripe's own terms of service and privacy policy.
Where the Service Provider qualifies as a trader and you are a consumer within the meaning of applicable EU law, you may have a right of withdrawal from a distance contract within 14 calendar days without giving any reason, subject to the exceptions provided by law.
Where you expressly request that performance of the service begin before the withdrawal period expires, and performance has commenced, you acknowledge that your right of withdrawal is extinguished upon full performance of the service, and you waive this right in advance in accordance with Article 38(1)(a) of Directive 2011/83/EU (Consumer Rights Directive).
Where legally applicable, the Service Provider provides a statutory warranty for defects / conformity of the digital service with the contract, in accordance with the relevant provisions of Polish civil law and Directive (EU) 2019/770 on contracts for the supply of digital content and digital services.
The user bears full legal responsibility for all content and images published on the Platform. Spotnest.com provides technical infrastructure only and does not endorse or identify with any opinions, descriptions, or representations posted by users.
The Service Provider shall not be liable for any indirect, incidental, or consequential damages arising from the use of or inability to use the Platform, to the maximum extent permitted by applicable law.
All elements of the Platform (including its interface, source code, graphics, and trademarks) are the exclusive property of the Service Provider or its licensors and are protected by copyright law. Users retain ownership of their submitted content but grant the Service Provider a non-exclusive, royalty-free, worldwide licence to display, store, and technically process that content solely for the purpose of operating the Platform.
The Service Provider processes personal data in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation — GDPR). Detailed information regarding the scope, purposes, legal bases of processing, and your rights (including data sharing with Google and Stripe) can be found in our Privacy Policy.
These Terms and Conditions are governed by and construed in accordance with the law of the Republic of Poland. Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the competent courts of ordinary jurisdiction in Poland, with territorial jurisdiction determined by the registered address of the Service Provider, without prejudice to any mandatory consumer protection provisions that may apply under the law of the user's country of habitual residence.
The Service Provider reserves the right to amend these Terms and Conditions at any time. Users will be informed of any material changes by e-mail or via a prominent notice on the Platform. Continued use of the Platform after the effective date of the amended Terms constitutes acceptance of the new version.
As part of the Spotnest.com platform, we provide an automated virtual assistant based on artificial intelligence (AI), whose purpose is to facilitate navigation of the portal and to provide general information about how it works.
Responses and content generated by the AI Assistant are for informational and auxiliary purposes only. Under no circumstances do they constitute legal, financial, tax, or investment advice.
Due to the nature of AI technology, the Service Provider does not guarantee the complete accuracy or completeness of the generated responses.
The Service Provider of the Spotnest.com platform shall not be liable for any decisions (including decisions to enter into an agreement, determine the amount of key money, deposits, or the interpretation of tenants' rights) made by Users based on information obtained from the AI Assistant. Any direct transactions are concluded at the Users' sole risk.

If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
