Housing Tax Relief (Own Housing Needs Exemption)
A PIT exemption on the capital gain from selling real estate within 5 years of acquiring it, available when the seller reinvests the proceeds in their own housing needs within a statutory 3-year period.

The housing tax relief (ulga mieszkaniowa) is set out in Article 21(1)(131) of the Personal Income Tax Act. Selling real estate before 5 full calendar years have passed since its acquisition normally triggers 19% PIT on the gain (the difference between the sale price and the acquisition cost). This relief exempts that gain from tax, in proportion to how much of the proceeds is spent on the seller's own housing needs — buying another home, land for one, renovating an existing property, or repaying a mortgage taken out for such a purpose.
The reinvestment must happen within 3 years, counted from the end of the calendar year in which the sale took place — not 3 years from the sale date itself, which effectively gives sellers who sell early in a year close to 4 full years to reinvest. Spending on a property purchased purely for rental or investment purposes, rather than the seller's own housing, does not qualify.
Selling after the 5-year holding period passes avoids the tax entirely, without needing to claim this relief at all — the relief exists specifically for sales that happen earlier, where reinvestment is the seller's only route to avoiding the 19% tax on the gain.

An owner sells an apartment bought 3 years earlier at a profit, then uses the entire proceeds within 3 years to buy a new home for themselves — the gain is fully exempt from PIT.
A seller reinvests only half the proceeds from an early sale into a new home and spends the rest on something unrelated to housing — only the reinvested half of the gain qualifies for the exemption.
An owner who waits until the 5-year holding period has passed before selling owes no PIT on the gain at all, regardless of what they do with the proceeds.
A seller uses part of the proceeds to pay off a mortgage they took out to buy the very property they're now selling — that portion counts toward their own housing needs and qualifies for the relief.
