A land ownership certificate (akt własności ziemi) was issued under the 1971 Act on the Regularization of Ownership of Farms, which confirmed ownership for farmers who had been cultivating land for years — often without a formal deed — as the legal successors of pre-war owners or through long, undocumented possession. The certificate was issued by the local administrative authority of the time (the commune office or the presidium of the county national council), not by a notary or a court.

Legally, a land ownership certificate has the same force as a final court ruling establishing ownership, and it remains a valid basis for entering the owner into the land and mortgage register. In practice, many rural plots that changed hands only within the family, or were never sold since the certificate was issued, still have no separate register opened at all — the certificate itself is the only proof of title in existence.

A buyer encountering a plot with only a land ownership certificate and no register entry should treat this as a red flag requiring extra diligence: without a register, there is no independent, court-verified record of the current owner, any co-ownership shares, or encumbrances, and establishing a first register entry (założenie księgi wieczystej) can take considerable time before a sale can close.
