Building Conditions Decision (WZ)

An administrative decision setting the parameters a specific plot may be built to when no local zoning plan covers it — the alternative route to establishing what may legally be built, alongside the local zoning plan.

Definition

The building conditions decision (decyzja o warunkach zabudowy, abbreviated WZ) is governed by the Act of 27 March 2003 on Spatial Planning and Development. A large share of Polish municipal territory is not covered by a local zoning plan (MPZP); for a plot without one, a building conditions decision is required before a building permit can be issued, since it — rather than a plan — sets the site-specific rules: permitted building height, roofline, footprint, and function.

To be granted, the plot generally must satisfy the good neighborhood principle (zasada dobrego sąsiedztwa) — at least one neighboring plot accessible from the same public road must already have development of a similar function that the new decision can reasonably continue, along with adequate access to that road and existing utility infrastructure or a realistic plan to provide it. The decision is issued by the mayor or municipal president (wójt, burmistrz, or prezydent miasta) following an application from anyone, not necessarily the plot's owner — obtaining one does not itself grant any rights to the land.

Examples

A buyer interested in a plot in an area without a local zoning plan applies for a building conditions decision before making an offer, to confirm what kind of house may actually be built there.

An applicant's request is denied because the surrounding plots along the same road have no similar existing development for the new building to continue, failing the good neighborhood test.

A developer secures a building conditions decision for a plot they don't yet own, using it to demonstrate the site's development potential to prospective buyers or partners.

How this affects buying and selling

Buyers should never assume a plot without a local zoning plan is freely buildable to any specification — the building conditions decision is what actually defines the permitted parameters, and a decision for a neighboring plot doesn't automatically apply to a different one. Because anyone can apply for a WZ decision regardless of ownership, a seller marketing land as having "confirmed building conditions" should be asked to show the actual decision and confirm it hasn't expired or been tied to a design the buyer doesn't intend to use.
